Terms of Service — Eschere

1. General Provisions

These Terms of Service govern the use of the online store available at eschere.com and the rules for placing and fulfilling orders through it.

Eschere operates as a distribution store providing customers access to products offered by external suppliers without storing inventory. Products are shipped directly from foreign supplier warehouses to customers. By placing an order the customer becomes the importer of the goods and is responsible for all customs formalities and import taxes unless the supplier uses the IOSS system in which case VAT is included in the product price. We do not file customs declarations or act as the customer's representative.

Sales through our store are not subject to VAT in Poland and the place of taxation is the country of origin of the goods unless the supplier uses IOSS. Customers are informed before placing an order whether the price includes VAT through IOSS or whether they are responsible for VAT and customs fees. We reserve the right to restrict availability of our offer to certain customer groups or regions and customers will be informed before placing an order.

2. Order Fulfillment

Products available in our store are offered through partnerships with foreign suppliers. After an order is placed and full payment is received we forward the order to the relevant supplier who prepares and ships the product directly to the customer. Unpaid orders may be cancelled after 3 business days.

Our order processing time is up to 7 business days from the day after payment is confirmed. Final delivery time depends on the supplier and customer location and may range from 4 to 45 business days which the customer accepts by placing an order.

We are not liable for delivery delays caused by factors beyond our control including supplier actions, logistics partners, transport delays, customs inspections, force majeure or incorrect addresses provided by the customer. If delivery is delayed beyond 45 business days from the date the order was forwarded to the supplier the customer has the right to withdraw from the contract and receive a full refund provided they submit a written request to contact@eschere.com within 7 days of that deadline.

3. Purchasing

By placing an order the customer enters into a sales contract with eschere.com under the terms set out herein. We reserve the right to refuse an order in cases of technical errors on the website, errors in product descriptions or prices, unavailability of the product at the supplier and suspected violation of these Terms by the customer.

Product prices are gross prices including VAT where the supplier uses IOSS. Where IOSS is not used prices do not include VAT or customs fees for which the customer is responsible as the importer. Information about VAT treatment and any additional customs costs is clearly displayed before order placement. We reserve the right to change product prices without prior notice however price changes do not affect orders already placed and paid for.

4. Our Liability

We make every effort to ensure product information is accurate and up to date. We are not liable for changes in product availability after an order is placed due to supplier actions, for delivery delays caused by suppliers, logistics operators or the customer, or for product quality issues caused by suppliers. However we commit to supporting customers through the complaints process in accordance with applicable law including the General Product Safety Regulation (GPSR).

5. Customer Data and Privacy

Customer personal data is processed solely for order fulfillment and in accordance with applicable data protection regulations (GDPR). To fulfill orders customer data may be shared with suppliers, logistics partners and payment operators. By placing an order the customer consents to such data sharing. 6. Product Safety (GPSR)

All products offered in our store meet the safety requirements set out in the GPSR and carry CE marking where required. If a product is found to pose a safety risk we will withdraw it from sale and notify customers by email with return instructions as detailed in our Refund Policy. Product safety concerns should be directed to contact@eschere.com and we will respond within 24 hours and take action in accordance with GPSR. Customers are required to follow product usage instructions provided by suppliers to ensure safe use.

7. Complaints and Returns

In the case of a defective item the customer has the right to file a complaint under statutory warranty provisions. Complaints must be submitted as soon as the defect is discovered and no later than 2 years from delivery by emailing contact@eschere.com. The complaint should include the order number, description of the defect, customer contact details and photos where applicable. Return shipping costs for complaints are borne by the customer unless we decide otherwise. Complaints are processed within 14 business days of receiving a complete submission. If supplier contact is required the process may take up to 30 business days and the customer will be informed. Consumers have the right to withdraw from the contract within 14 days of receiving the goods without giving any reason in accordance with consumer protection law. 8. Final Provisions

We reserve the right to update these Terms of Service at any time. The current version is always available at eschere.com and changes do not affect orders placed prior to the update. By placing an order the customer accepts these Terms of Service. Any disputes arising from sales contracts shall be resolved by the court with jurisdiction over our registered address unless otherwise required by law.
