1. Purposes and Legal Basis for Processing

We process your personal data for the following purposes:

Order fulfillment, including transferring data to foreign suppliers (Art. 6(1)(b) GDPR – performance of a contract). Handling inquiries, complaints and returns (Art. 6(1)(f) GDPR – legitimate interest). Sending newsletters if you have given consent (Art. 6(1)(a) GDPR – consent). Website traffic analysis and store optimization (Art. 6(1)(f) GDPR – legitimate interest). Processing payments through external payment operators (Art. 6(1)(b) GDPR – performance of a contract).

2. What Data Do We Collect?

Depending on your activity in the store we collect: first and last name, email address, delivery address, phone number and transaction data processed exclusively by payment operators. We do not store payment card data — it is processed directly by payment operators in accordance with their privacy policies. Data such as name and delivery address are transferred to foreign clothing suppliers solely for order fulfillment purposes. The customer as the importer is informed of this before placing an order.

3. Recipients of Personal Data

Your data may be shared with: foreign clothing suppliers for order fulfillment, courier and logistics companies, payment operators, Shopify Inc. as the e-commerce platform provider and analytics service providers. Each recipient processes data in accordance with GDPR and data processing agreements.

4. Data Retention

We retain your data for: the time necessary to fulfill the order including returns and complaints, the period required by law (5 years for tax purposes from the end of the transaction year), the duration of marketing activities until consent is withdrawn and the time needed to handle product safety reports.

5. Your Rights

Under GDPR you have the following rights: access to data (Art. 15), rectification (Art. 16), erasure / right to be forgotten (Art. 17), restriction of processing (Art. 18), data portability (Art. 20), objection to processing (Art. 21) and withdrawal of consent at any time (Art. 7(3)). You may also lodge a complaint with the President of the Personal Data Protection Office (UODO) if you believe your data is being processed unlawfully.

6. Cookies and Tracking Technologies

Our website uses cookies to ensure proper store functionality, analyze traffic and personalize content and ads. We use Shopify tools to manage cookies and track activity. You can manage cookie settings in your browser or directly on our website.

7. Data Transfers Outside the EEA

By using Shopify your data may be transferred outside the European Economic Area primarily to Canada. Shopify Inc. applies safeguards compliant with GDPR including standard contractual clauses. Customers are informed of data transfers before placing an order.

9. VAT and Customs

The customer acts as the importer of goods and is responsible for customs formalities and VAT unless the supplier uses the IOSS system in which case VAT is included in the price. Information about VAT and any potential customs costs is provided before order placement in a clearly visible location.

We reserve the right to update this Privacy Policy at any time. The current version is always available at eschere.com and changes take effect upon publication.
